Readers are awaiting a new encounter with stories united under the common title Why We Are in Need of Tales. Let me remind you that these deep philosophical books were written by Maria daVenza Tillmanns, a professional philosopher dedicated to the study of philosophizing with children, who has gained valuable experience in this field. Maria’s books are inspired by her work with her students at El Toyon Elementary School in National City (California), with whom Maria held philosophy with children classes (...) for three years before COVID-19. With parental permission, the children provided their drawings, which are used as illustrations for the books. I read Why We Are in Need of Tales, Part III with great pleasure. The focus of this book is on making decisions, sometimes very hard decisions. In Part II, the focus is on dreams — hopes and wishes we have for life. This book looks at how we may best decide how to make those hopes and wishes come true. And the answer Huk and Tuk suggest is deceptively easy: by making decisions “with your eyes wide open.” (5, p. ix). The author of this excellent book managed to describe how to make decisions with your eyes wide open through the playful dialogue between Huk and Tuk. The books are written in dialogue so the reader immediately plunges into the context of a lively conversation. Dialogue not only sharpens attention, but also invites the reader to participate in the conversation. In this way, the reader becomes a listener at the same time. (shrink)

In the paper I am concerned with various manifestations of aesthetic fear and anxiety, that is, fear and anxiety triggered by works of art, which I am discussing from aesthetic as well as anthropological perspectives. I am analysing the link between fear and pleasure in catharsis, in Edmund Burke’s notion of the sublime, and in reference to Goya’s Black Paintings and to Paul Virilio’s thought. Both aesthetic fear and aesthetic anxiety exist alongside other emotions, such as pity and sadness, and, (...) most notably, with pleasure which is autonomous or arises from the fascination with evil. I am proposing here an examination o f the text Reading Capital, written by Louis Althusser in 1965. I will consider it as a text in the history o f philosophy. In Reading Capital Althusser explicitly asks which philosophy provides the basis, the foundation, for Marx’s scientific work? In this sense, Reading Capital is, at the same time, a text in the history o f philosophy and a text in the philosophy o f science. In research on Marx’s philosophy, it (...) becomes essential in the Althusserian argument to consider Marx’s historical position in relation to the school o f classical economy, on the one hand, and to Hegel’s philosophy, on the other. It is generally agreed that for blame to be appropriate the wrongdoer must be blameworthy. However, blameworthiness is not sufficient for appropriate blame. It has been argued that for blame to be appropriate the blamer must have standing to blame. Philosophers writing on the topic have distinguished several considerations that might defeat someone’s standing to blame. This paper examines the underexplored consideration of how personal relationships can influence who has the standing to express blame. We seem to assume that if (...) we do not stand in the right relation to the wrongdoer, it is not our business to blame them. I identify three challenges to this view. First, we do not know what is wrong with meddling (whether it is morally or prudentially wrong). Second, there are cases where we have no close relation to the wrongdoer, but where we seem to have standing nonetheless – murder and other serious moral offences are examples of this. Third, we don’t seem to have a clear conception of what ‘standing’ means, and this makes it hard to see how discussion on standing can help us determine the propriety of blame. This paper defends the notion of standing as a propriety condition on blame in cases of meddling. I argue that personal relationships influence who has the standing to blame through constitution of relationship-specific norms; and that the role these norms play in developing and regulating our relationships can explain why meddlesome blame is morally wrong. This paper focuses on negative exemplarity-related emotions (NEREs) and on their educational implications. In this paper, we will first argue for the nonexpendability of negative emotions broadly conceived (section 2) by defending their instrumental and intrinsic role in a good and flourishing life. In section 3, we will make the claim more specific by focusing on the narrower domain of NEREs and argue for their moral and educational significance by evaluating whether they fit the arguments provided in the previous section. (...) In section 4, we will propose three educational strategies to foster NEREs’ positive moral role. In conclusion, we will point out that an exemplarist approach to character education would greatly benefit from a more fine-grained account of the emotions involved in the educational process and from a broader perspective on which of these emotions should be taken as valuable for educational purposes. The aim of this paper is an ontological clarification of the concept of artefact. The following questions are addressed: 1. Do artefacts constitute an ontological category of objects in its own right, and if so, how could this category be characterized? 2. How do artefacts come into existence? 3. What kind of artefacts are there, and in which relations do they stand to each other? It is argued that artefacts are characterized essentially through their genesis and that they owe their (...) existence to mental acts of a particular kind, which I call “acts of creation”. It is maintained that there are not only concrete, material artefacts, but also abstract artefacts, that is, artefacts that cannot be perceived through the senses and are not located in space. Furthermore, it shall be claimed that in a sense those abstract artefacts are even primary to the concrete, material artefacts. (shrink)

Important empirically informed proposals of virtue cultivation invoke techniques of goal pursuit. This paper argues that these techniques are effective in changing behavior due to the attention narrowing they bring about, and further show that such attention narrowing can threaten the appropriate exercise of phronetic-related capacities. When these phronetic-related capacities are threatened, two derivative problems arise: (1) One can end up acting in morally inappropriate ways, and (2) Even in cases where one performs the morally appropriate action, one nonetheless can (...) fail to notice and appreciate features of moral value. In light of these concerns, such techniques of goal pursuit – at least, by themselves – serve the most good for those who are merely trying to avoid vice, rather than cultivate virtue. And so, I suggest that such accounts of virtue cultivation are incomplete. I then go on to argue that these undesirable effects of attention narrowing brought about by these goal pursuit techniques may be ameliorated by also engaging in certain indirect modifications of cognition, particularly those which broaden attention. The suggestion, then, is that attention narrowing techniques of goal pursuit, along with attention broadening modifications, might best facilitate virtue cultivation when employed together. While the particulars of how we might best go about this are currently unclear, this paper ends by looking at empirical research on Open Monitoring Meditation as providing a hopeful option that might be further investigated. This paper investigates civility from an Aristotelian perspective and has two objectives. The first is to offer a novel account of this virtue based on Aristotle’s remarks about civic friendship. The proposed account distinguishes two main components of civility—civic benevolence and civil deliberation—and shows how Aristotle’s insights can speak to the needs of our communities today. The notion of civil deliberation is then unpacked into three main dimensions: motivational, inquiry-related, and ethical. The second objective is to illustrate how the post-truth (...) condition—in particular, the spread of misinformation typical of the digital environments we inhabit—obstructs our capacity to cultivate the virtue of civility by impairing every component of civil deliberation. The paper hopes to direct virtue theorists’ attention to the need to foster civic virtues as a means of counteracting the negative aspects of the post-truth age. (shrink)

The administrative discretionary act differs from regulated act because while the latter refers to the simple execution of the law, the former refers to cases where there is some leeway for a further understanding and application of the rule. For example, discretionary is necessary when the law can provide two possible proceedings, none of which is mandatory. It is also necessary when legislation merely indicates its ends, without specifying the means to achieve them. When it is not dissociated from the (...) exercise of the discretion of a constituted authority, discretionary is the opposite of arbitrariness. After defining this important notion, this paper emphasizes two highlights of it, namely, that the foundation of its power lies in the law itself, and that the distinguishing feature of a discretionary act is the justification of the reasons for the decision. La (esencia de la) dignidad sería, por consiguiente, relativa. Analicemos esto.

The current “exemplarist turn” within virtue ethics is increasingly shedding light on the importance of exemplars both as enabling one to identify the virtues and for the importance they bear for orienting one’s conduct, as well as for educating the novice. However, even if categorizations of exemplars have already been proposed, there seems to be a lack of discussion on the kind of imitation different exemplars are supposed to elicit. In order to offer a preliminary answer to this question, in (...) this paper I present three paths to flourishing via imitation of exemplary individuals: The Platonic, the Stoic, and the Aristotelian. Then, I sketch an attempt to reconcile these models. In conclusion, I suggest that, when it comes to education, this reconciliation becomes necessary. Along these lines, I recommend that a multi-step educational program is elaborated. (shrink)

Human nature has always been a foundational issue for philosophy. What does it mean to have a human nature? Is the concept the relic of a bygone age? What is the use of such a concept? What are the epistemic and ontological commitments people make when they use the concept? In What’s Left of Human Nature? Maria Kronfeldner offers a philosophical account of human nature that defends the concept against contemporary criticism. In particular, she takes on challenges related to social (...) misuse of the concept that dehumanizes those regarded as lacking human nature (the dehumanization challenge); the conflict between Darwinian thinking and essentialist concepts of human nature (the Darwinian challenge); and the consensus that evolution, heredity, and ontogenetic development results from nurture and nature. After answering each of these challenges, Kronfeldner presents a revisionist account of human nature that minimizes dehumanization and does not fall back on outdated biological ideas. Her account is post-essentialist because it eliminates the concept of an essence of being human; pluralist in that it argues that there are different things in the world that correspond to three different post-essentialist concepts of human nature; and interactive because it understands nature and nurture as interacting at the developmental, epigenetic, and evolutionary levels. On the basis of this, she introduces a dialectical concept of an ever-changing and “looping” human nature. Finally, noting the essentially contested character of the concept and the ambiguity and redundancy of the terminology, she wonders if we should simply eliminate the term “human nature” altogether. After a brief introduction about the problem of leopardian sources, I wish to introduce here a description of the diffusion of Addison’s theories about the Imagination in Italy at the time of Leopardi, trying to highlight their influence on his thinking and his philosophy. The third chapter is dedicated to the analysis of an important excerpt of the Zibaldone where Leopardi quotes Addison and his Catone to introduce an interesting reflection about the pleasure of beauty and the role of imagination, (...) almost as a way to face Addison issues.This excerpt represents an occasion to compare the theories of Addison and Leopardi about Aesthetics and also the similarities and the differences between them. The last part of the paper is dedicated to the results of the analysis and the conclusions. (shrink)

Natural languages exhibit a great variety of grammatical paradigms. For instance, in English verbs are grammatically marked for tense, whereas in the tenseless Eskimo-Aleut language Kalaallisut they are marked for illocutionary mood. Although time is a universal dimension of the human experience and speaking is part of that experience, some languages encode reference to time without any grammatical tense morphology, or reference to speech acts without any illocutionary mood morphology. Nevertheless, different grammatical systems are semantically parallel in certain respects. Specifically, (...) I propose that English tenses form a temporal centering system, which monitors and updates topic times, whereas Kalaallisut moods form a modal centering system, which monitors and updates modal discourse referents. To formalize these centering parallels I define a dynamic logic that represents not only changing information but also changing focus of attention in discourse (Update with Centering, formalizing Grosz et al 1995). Different languages can be translated into this typed logic by directly compositional universal rules of Combinatory Categorial Grammar (CCG) The resulting centering theory of tense and illocutionary mood draws semantic parallels across different grammatical systems. The centering generalizations span the extremes of the typological spectrum, so they are likely to be universal. In addition, the theory accounts for the translation equivalence of tense and illocutionary mood in a given utterance context. Following Stalnaker (1978) I assume that the very act of speaking up has a ‘commonplace effect’ on the context. It focuses attention on the speech act and thereby introduces default modal and temporal topics. These universal defaults complement language-specific grammars, e.g. English tenses and Kalaallisut moods. In a given utterance context the universal discourse-initial defaults plus language-specific grammatical marking may add up to the same truth conditions.. (shrink)

Thema der Arbeit ist der ontologische Status von Werken sowie die Beziehung zwischen Werken einerseits und Aufführungen, Manuskripten, Partituren, Schallplatten, Gemälden, Gebäuden, Drucken etc. andererseits. Es wird angeknüpft an den phänomenologischen Ansatz von Roman Ingarden (aber auch an den von Alexius Meinung). Diese Ansätze werden unter Verwendung moderner logischer Hilfsmittel weiterentwickelt und, wo notwendig, revidiert. Im ersten Kapitel wird ausführlich begründet, warum Werke (und zwar Werke aller Gattungen) abstrakte, typenartige Gegenstände sein müssen, die in konkreten Einzeldingen (z. B. Aufführungen) realisiert (...) sein können, jedoch von diesen Realisierungen in ihrer Existenz nicht abhängig sind. Diese These ist im weiteren Verlauf der Arbeit eine nicht mehr hinterfragte Grundvoraussetzung. Im zweiten Kapitel werden die formalen Grundlagen einer Typenontologie des Werks entwickelt. Zwei Hauptfragen stehen dabei im Vordergrund: (a) Wie kann ein Werk (also ein abstrakter Gegenstand) sinnliche Eigenschaften (z. B. Klangeigenschaften, Farbeigenschaften) haben? (b) Was macht einen Gegenstand zu einer Realisierung eines Werks? Welche Bedingungen müssen erfüllt sein, damit etwas eine Realisierung eines gegebenen Werks ist? Neben dem Begriff des Werks beruht die in dieser Arbeit entwickelte Theorie auf drei weiteren Grundbegriffen: Realisierungen, Konkretisierungen und Aktualisierungen. Realisierungen sind jene Gegenstände, in denen Werke realisiert sind. Konkretisierungen sind abstrakte Gegenstände, die durch "Vervollständigung" aus Werken hervorgehen. Sie sind immer noch unvollständig bestimmt, aber vollständiger bestimmt als die Werke, deren Konkretisierungen sie sind. Beispiele für Konkretisierungen sind Inszenierungen im Theater oder musikalische Interpretationen. Aktualisierungen sind die intentionalen Korrelate von Rezeptionsvorgängen. In this Chapter, Maria Kronfeldner discusses whether psychological essentialism is a necessary part of dehumanization. This involves different elements of essentialism, and a narrow and a broad way of conceptualizing psychological essentialism, the first akin to natural kind thinking, the second based on entitativity. She first presents authors that have connected essentialism with dehumanization. She then introduces the error theory of psychological essentialism regarding the category of the human, and distinguishes different elements of psychological essentialism. On that basis, Kronfeldner connects (...) historical, socio-psychological, and philosophical insights in order to show that although essentialism can act as a catalyst for dehumanization, it is not necessary for it. Examples relate to dehumanization in the context of colonialism and evolutionary thinking, to the history of dehumanizing women from Aristotle to 19th-century craniology, and to contemporary self-dehumanization and ‘lesser mind’ attribution. La perspectiva renacentista ha sido un ejemplo insistentemente trabajado en la literatura epistemologica, dado que permite establecer relaciones con la constitucion de la ciencia moderna y, a la vez, ofrece una fecunda metafora respecto de la actividad cognoscente propia de este modelo de racionalidad. En este trabajo, pretendemos examinar el uso critico de esta metafora y, para ello, seleccionamos tres lecturas procedentes de diferentes origenes y orientaciones teoricas que, a nuestro juicio, coinciden en: (1) la preocupacion por mostrar que la (...) asociacion de estos modos de representacion con el realismo esta lejos de ser obvia y directa; y (2) una cierta conciencia de haber pagado un costo muy alto por la sistematizacion y racionalizacion a las que han conducido estos modos de representacion. The article deals with some textual issues related with Aristotle’s treatise “On Youth and Old Age, Life and Death. This text is conventionally included in the so-called “small scientific works”. In the article I considers the title variants testified in the sources as well as the place the treatise occupies within the set of Aristotle’s scientific works. I trace the parallels of this treatise with another Aristotle’s works, such as “De longitudine et brevitate vitae” and “De anima”. The treatise is (...) further compared with Aristotle’s works on physics and biology, esp. “De partibus animalium”, “De motu animalium”, “De generatione animalium”. I discuss the concept of life, functions of the vegetative soul, its “medial” location, and Aristotle’s definition of the soul’s and body’s «midpoint» in respect to the «upward» and «downward» directions. For understanding the meaning of the term «innate natural heat» it is proposed to compare it with the terminology of such Aristotelian works as “De motu animalium” and “De generatione animalium”. Those who are – in the tradition of Meinong – willing to accept the claim that there are objects that do not exist usually argue that the ontological commitment to nonexistent objects allows to resolve a variety of problems of reference and intentionality, such as: the problem of singular negative existential statements, the problem of discourse on past and future objects, the problem of discourse on fictitious objects, the problem of counterfactual existentials, the problem of allegedly necessary truths on nonexistent (...) objects (e. g., "The round square is round".) It seems that the ontological commitment to nonexistent objects enables us to explain both the obvious truth of many predicative sentences whose subject terms do not denote anything existent and the possibility of intentional acts whose objects do not exist. The aim of this paper is to show that the commitment to nonexistents does not resolve any of these problems. Furthermore, some alternative solutions are delineated. (shrink)

The relationship between the necessity to ensure that information is shared in the stages of deliberation and the overcoming of what Dryzek (2001) called constriction of deliberative economy is directly related to the proponents and opponents’ propensity to submit and add information differently, in a plural manner. This article describes the salient features of the deliberative turn in order to defend that this propensity is not individual. The evolution of the public space in science and in politics are both paradigmatic (...) examples to appreciate that individual deliberation, and even mere aggregation of opinions, are consistently interpreted only if they are part of social practices and collective institutions aimed at defending tolerance towards positions, beliefs and interpretations that are different or even confronted. This paper argues that the so called model of contestatory deliberative democracy contributes to the acquisition of knowledge precisely because it fosters a plurality of epistemic states associated with practices as consensus and dissent. The aim of the study was to explore the motives underpinning career mobility, and the impact of such mobility on changing the perceptions of senior teacher educators from Israel who have experienced cross-cultural professional transitions during the mid-career stage (hereafter referred to as ‘internationally oriented teacher educators’). A thematic analysis of five interviewees’ retrospective narratives highlighted three motives driving career mobility: the opportunity for professional development; the joy of adventure and challenge; and the need to bring about a fundamental change (...) in their careers. In addition, two categories of changes in perceptions that occurred following international mobility were mapped: (a) pluralistic perceptions in a multicultural higher education environment, and (b) culture of learning among the younger generation. The discussion raises similarities and differences between the findings and the literature on career mobility in higher education. (shrink)

In this paper, I am predominantly interested in interpretations of emotional states portrayed in images of the face. In particular, the interpretations which have grown around the series of busts by Franz Xaver Messerschmidt, as well as those which attempt to expound Bill Viola’s video works. I will refer to aspects of physiognomy, artistic practices and aesthetics, in order to show what each of these tells us about our attitude to the body and emotions and what happens to the body (...) while a person is experiencing an emotion. My aim is to demonstrate how the act of depicting the body, regarded as a cognitive process in an artistic medium accompanied by a special kind of aesthetic experience, becomes a means of communication which is capable of conveying a universal message and of allowing us to define our attitude to the body. Que ambas pretensiones inspiren la sólida monografía de María G. Navarro —titulada Interpretar y argumentar— constituye empresa audaz y arriesgada, plena de coraje innovador, que provoca admiración, curiosidad e interés. Contra lo que pudiera parecer (...) a primera vista, el libro contiene un alto componente de originalidad y creatividad, debido a la estratagema metodoló-gica de que se sirve la autora. A saber, una hermenéutica in obliquo, estrategia consistente en interpretar a la hermenéutica gadameriana a través del prisma de la lógica de la argumentación. (shrink)

Este artículo muestra la conexión entre heurísticas sociales y deliberación. En lugar de caracterizar las heurísticas según disciplinas o campos, aquí se proyectan sobre nuestros enclaves deliberativos. La autora sostiene que el empleo de heurísticas sociales orienta el flujo de la información y la participación en las distintas fases deliberativas, y es necesario analizarlas para establecer indicadores con los que medir grados de deliberación. Esta hipótesis da lugar a una visión pluralista sobre la función social de las heurísticas entendidas como (...) caja de herramientas con nuevos instrumentos y utilidades sociales. Según dicha perspectiva, habría que integrar este tipo de razonamiento en un plan de acción más amplio que explicara en qué sentido las heurísticas son recursos que producen conocimiento, al tiempo que un tipo de conocimiento ya producido. This article sheds light on moral education from an exemplarist perspective. Following Linda Zagzebski's Exemplarist Virtue Theory, we relate several fundamental exemplarist intuitions to the classical virtue ethical debate over the unity-disunity of the virtues, to endorse a pluralistic exemplar-based approach to moral education ("Empe"). After a few preliminary remarks, we argue that Empe amounts to defending "a prima facie" disunitarist perspective in moral theory, which admits both exemplarity in all respects (moral sainthood) and single-domain exemplarity (moral heroism). Then, we (...) evaluate the effectiveness of heroes and saints for moral education, according to four criteria derived from Empe. This analysis allows us to conclude that moral education should value both kinds of exemplars and, therefore, adopt weaker standards of exemplarity than the unitarist's ones. (shrink)

Even when they are defined with precision, one can often read and hear judgments about the vagueness of heuristics in debates about heuristic reasoning. This opinion is not just frequent but also quite reasonable. Even one and the same author may offer more than one definition of what he understands by argumentation: this is partly because the problem of argumentation is not confined to a single area of knowledge or of practical life. Definitions of argumentation are as varied as the different positions taken on the question of what exactly we do when we argue. ABSTRACT. In this paper, I defend a strong version of actual intentionalism. First, I argue against meaning subjectivism, conventionalism and contextualism. Second, I discuss what I take to be the most important rival to actual intentionalism, namely hypothetical intentionalism. I argue that, although hypothetical intentionalism might be acceptable as a definition of the concept of utterance meaning, it does not provide an acceptable answer to the question of what determines an utterance’s meaning. Third, I deal with the most serious objection (...) against actual intentionalism, namely the failure objection. I argue that the failure objection can be overcome within a framework of full-blown actual intentionalism if one distinguishes between categorial and semantic intentions. Moreover, I show how this version of actual intentionalism accounts for the possibility of innovative metaphors and other implicatures. Finally, I demonstrate that actual intentionalism – thus construed – makes it possible to distinguish between communicative failures and the intentional breaking of conventions. (shrink)

Mostraremos que el desacuerdo entre pesimistas y optimistas sobre la resolución racional de los desacuerdos profundos no se ubica en el nivel del contenido, de lo que están diciendo, sino en uno diferente. Para mostrar por qué es así, proponemos detenernos en el funcionamiento lógico-semántico del término clave en este desacuerdo: “racional”. Iniciaremos con el repaso de algunos argumentos que pesimistas y optimistas han esgrimido en su discusión, y comprobaremos la diferencia de estándares ya mencionada (sección 1); luego, nos detendremos (...) en las particularidades lógico-semánticas de “racional”, y explicitaremos lo que hacen los hablantes cuando realizan movidas lingüísticas con él (sección 2); y para finalizar, volveremos sobre el desacuerdo entre pesimistas y optimistas, y mostraremos por qué, a pesar de la diferencia, permanece como un desacuerdo genuino y es importante seguir inmiscuidos en esta discusión. El análisis lógico-semántico nos mostrará que “racional” no es usado para describir un estándar de racionalidad independiente de cualquier contexto, sino para expresar ciertas actitudes respecto de lo que decimos o hacemos. A pesar de la diferencia de estándares, pesimistas y optimistas siguen inmiscuidos en un desacuerdo genuino porque discrepan acerca de ciertas actitudes que hay que adoptar con respecto a, en este caso específico, los DP. Maria Kronfeldner’s Preface and Introduction to the Routledge Handbook of Dehumanization maps the landscape of dehumanization studies. She starts with a brief portrayal of the history of the field. The systematically minded sections that follow guide the reader through the resulting rugged landscape represented in the Handbook’s contributions. Different realizations, levels, forms, and ontological contrasts of dehumanization are distinguished, followed by remarks on the variety of targets of dehumanization. A discussion on valence and emotional aspects is added. Causes, functions, and (...) consequences of dehumanization, and the prospects for reducing or undoing it, are introduced. The systematic overview closes with a discussion of some important theoretical complexities that arise in studying dehumanization. After these systematic sections, the scholarly work on dehumanization gets situated in the broader intellectual landscape of debates about the ‘human’ in the humanities and social sciences. En estas páginas hemos presentado varios argumentos para defender que existe una conexión entre el empleo de heurísticas y los procesos de deliberación. En lugar de caracterizar las heurísticas en función de las disciplinas, los campos y/o los ámbitos en que se emplean—tal y como hace, por ejemplo, el grupo ABC, i.e. racionalidad ecológica—las hemos proyectado sobre nuestros enclaves deliberativos, esto es, sobre un espacio eminentemente retórico y político. En dichos enclaves, tal y como solía recordarnos Quintín Racionero, la téchne (...) de la persuasión se nos presenta como parte del órganon de la filosofía práctica porque está aplicada a un espacio ontológico fundado por la comunicación humana. Y es en el seno de dicha comunicación como cabe entender la proliferación de razonamientos heurísticos encaminados al cálculo, la estimación y/o la ponderación, con ayuda de los cuales no sólo se orienta la acción colectiva sino las mismas fases de la deliberación. Este término se suele utilizar para referir teorías, categorías y principios que explican e interpretan fenómenos relacionados con el conocimiento que los seres humanos poseen sobre el mundo social.

Creativity has often been declared, especially by philosophers, as the last frontier of science. The assumption is that it will defy explanation forever. I will defend two claims in order to oppose this assumption and to demystify creativity: (1) the perspective that creativity cannot be explained wrongly identifies creativity with what I shall call metaphysical freedom; (2) the Darwinian approach to creativity, a prominent naturalistic account of creativity, fails to give an explanation of creativity, because it confuses conceptual issues with (...) explanation. I will close with some remarks on the status and differences in some explanations available in contemporary cognitive science. (shrink)

One of the challenges related to the discursive practices of argumentative agents is to get to know if those interactions have an institutional effect. In this article, it is argued that in the new institutionalism, theoretical approaches and deterministic analysis are outlined to investigate argumentative practices that take place in processes of legitimation and recognition. Here a double socio-institutional and discursive or constructivist approach to the argumentation theory is defended, and it is argued that this perspective could be extended to (...) a research program aimed at interpreting argumentative processes in the public sphere that act as calculation mechanism and conformation of social capital. The neo-Leibnizian mark characterizes both his philosophical thesis and the terms has coined in his contributions to the theory of knowledge, theodicy, ontology, political philosophy, etc. Above all, this mark is present in his conception of Law and of the logic of legal situations.
